In her dissent, Justice Sonja Sotomayor, calling the shadow docket ruling inexcusable, pointed out how destructive this is to the rule of law (both US and international law largely prohibit this) and to the lives of the people who may be deported without due process:
The Government has made clear in word and deed that it feels itself unconstrained by law, free to deport anyone anywhere without notice or an opportunity to be heard. The episodes of noncompliance in this very case illustrate the risks.
The Due Process Clause represents the principle that ours is a government of laws, not of men, and that we submit ourselves to rulers only if under rules. By rewarding lawlessness, the Court once again undermines that foundational principle.
In matters of life and death, it is best to proceed with caution. In this case, the Government took the opposite approach. It wrongfully deported one plaintiff to Guatemala, even though an Immigration Judge found he was likely to face torture there. Then, in clear violation of a court order, it deported six more to South Sudan, a nation the State Department considers too unsafe for all but its most critical personnel.
This ruling by six corrupt Republican justices allows Donald Trump or any future president to designate any country they choose as a safe third country and deport people there without meaningful review, even if theyve committed no crime and have a valid asylum claim.
If that sounds familiar, it should. It echoes one of the most cold-blooded decisions made by Hitlers Nazi regime: to locate their extermination camps not within Germany, but in the foreign lands of occupied Poland.

Jane Roberts, the wife of Chief Justice John Roberts, acknowledges having represented a wide variety of public officials including senior Justice Department officials and Cabinet members as they transitioned to jobs in the private sector, according to testimony in an arbitration hearing to resolve a lawsuit filed by an ex-colleague against her former legal recruiting business.
A partial transcript of that testimony was included in a complaint submitted to the House, Senate and Justice Department filed in December on behalf of the former colleague.

Jane Roberts placements included at least one firm with a prominent Supreme Court practice, according to the complaint, which also includes sworn testimony from Roberts herself, in which she notes the powerful officials whose agencies have had frequent cases before her husband for whom she has worked.
A significant portion of my practice on the partner side is with senior government lawyers, ranging from U.S. attorneys, cabinet officials, former senators, chairmen of federal commissions, general counsel of federal commissions, and then senior political appointees within the ranks of various agencies, and I -- they come to me looking to transition to the private sector, Roberts said, according to a transcript of a 2015 arbitration hearing related to her former colleagues termination.
In her testimony, Roberts also noted the benefit of working with senior government officials: Successful people have successful friends.

(5,693 posts)As I've said numerous times before, the man has a GIFT for seeing the big picture however complex, for recognizing Trump/MAGA for what they are and what's ultimately their ENDGAME,
and just as importantly,
for spelling it out in a manner so clear and concise, that only the willfully and stubbornly bamboozled could fall to grasp it.
