Mentioning the name brands of Tylenol and Advil rather than saying Acetaminophen and Ibuprofen which opens you up to devastating lawsuits is exactly what I expect when it comes to the incompetency of this administration

He does so much slandering of people and businesses -- and their reputations, yet I have yet to hear or view any definition of what the SCOTUS defined to be an "official act" versus this jerk's general, defaming bull shitery. As I recall, the Supremes left it up to one of the courts to make that determination, but it never happened.

(40,078 posts)CORRECTION: Bill Clinton was sued for actions taken before he was President, and outside of his official responsibilities. The law does allow that.
However, it seems to me that many of Anus Orange's actions have nothing to do with his official responsibilities, but are geared only to personal revenge. But that would be a much harder legal argument to make, since the relevance of each and every point would be hashed out over many years.

(37,710 posts)or lose it, like Bayer did with its trademark: Aspirin - which is now no longer their mark because they allowed it to be used generically for acetylsalysylic acid.
There are a variety of ways of protecting their mark - but they all involve not allowing others to use it as a noun rather than an adjective (Tylenol, instead of tylenol brand acetaminophen; Motrin or Advil, instead of Motrin brand ibuprofen or Advil brand ibuprofen). Others include those with a big megaphone, like the president.

(954 posts)Anyone who thinks this will result in any civil suit doesnt understand the law. You would have to sue the individuals making the statements and you would have to get passed immunity that they were acting in their official capacity which will be (extremely) difficult. And Trump has further immunities the current SCOTUS gave him which are going to be impossible to defeat with the current SCOTUS as is.

Of course, anyone who thinks his hand-picked people at the SEC and/or DoJ will do jack about it (other than maybe get in on the short-selling gravy train themselves) doesn't understand just how compromised our entire system of Law has been under this lawless tyrant.

(317 posts)I dont claim to be a specialist in federal law, but definitive statements about the law always give me pause. There is no single law to understand. Theres a complex of pragmatic, legislational, precedental, and jurisdictional questions to consider in filing suit. The FTCA is a limited waiver of sovereign immunity to cover wrongful or negligent acts by federal employees. The waiver is limited and FTCA claims are complex, but i dont think a belief that a suit is possible says anything about ones understanding of the law.

(1,604 posts)"Trump just name dropped Tylenol, Motrin, Aspirin, and Advil and told people to not take any of them."
Insofar as "told people not to" in this context would be generally understood to mean "all people", and "just name dropped Tylenol, Motrin, Aspirin, and Advil" would be generally interpreted as meaning that he actually named all four in some (reasonably close) temporal proximity, the entire statement is rhetorically false as written. That is not what happened, apparently

(127,417 posts)When was the last time you were in a dollar store? The price went to 1.25 quite some time back, and most things are now 1.50 or more, as of a few months ago. Soooooo, 24 count dollar store brand ibu's 1.50 (per my latest trip to said store.) roughly .06/ pill. Kroger brand ibuprofen in 500 count 2-pack (1,000 pills total) 14.99, so .015/pill. Same with kroger brand tylenol.

But none of them has anything to do with autism. If you choose not to take anything, the only possible painkiller would be a prescription drugs. Acetaminophen is my only option. Thirty years ago I spontaneously developed an allergy to regular aspirin (and all other non-steroidal anti-inflammatory drugs) that could KILL me, and naturally I found this out the hard way. Eyes swelled shut so fast I only had time enough to fish out one contact lens, and I started drowning in my own...fluids. Luckily I was in the military, and at work, so I got taken to the ER pretty quick. Hospitalized for three days' observation, looking like a wasp nest went berserk on my eyelids. Nowadays I'm an arthritic old git who relies on topical painkillers just to get through the work day and if they aren't enough, it's time for Acetaminophen. Please, DO tell me more about "downsides" and "comfort," you coked-up dungbag.

(88 posts)1. Unfortunately, he can't get sued. That was decided way back in Nixon versus Fitzgerald. Even any comment, speech, or public message he makes would be considered in the scope of office or outer perimeter. It basically says he can't have any civil liability from action he does while in the scope of office as president. Even if what he says is completely wrong and defamatory. This announcement would clearly fall in that criteria.
2. If anyone missed it, you have to go back and watch the video of the announcement with him trying to pronounce Acetaminophen. It was probably the funniest thing I have seen him do recently trying to read that word and simply not being able to.
3. I keep an open mind about the study. I don't trust this administration and I don't trust Kennedy right now, but the study is the study and I will give a conscious effort to read it..
This is the letter that generated the announcement from the dean of Harvard medical.
Here is the Harvard study that reference is referring to that lead to this announcement.
https://hsph.harvard.edu/news/using-acetaminophen-during-pregnancy-may-increase-childrens-autism-and-adhd-risk/
