With the failure to indict Kelly, does that also wipe away Hegseth's threat to "downgrade" his rank and pension?

I haven't seen anything that specifically addresses it other than this:

Defense Secretary Pete Hegseth announced plans last month to downgrade Kelly’s retired U.S. Navy captain rank and pension over his supposedly “seditious statements.” Kelly subsequently sued the secretary of defense, noting that Hegseth once agreed with the message in the video.

a warning to the jag officers working on kelly's demotion:

if you give capt kelly a chance to show up in uniform at his court martial you are making him your commander in chief, and you already know what he thinks about your following the stupid and unlawful orders that got you there.
