(Salon) Samuel Alito, a suspected leaker of the Dobbs and Hobby Lobby Supreme Court decisions, wine aficionado and far-right flag waver, has a new book coming this fall.
Ordinarily, a Supreme Court justices book is an opportunity to line their pockets with a hefty advance, enjoy the perks of a lecture tour and sit for gentle interviews with handpicked partisans who gullibly swallow the usual line about how theyre students of the Constitution, not robed, opportunistic hacks.
Yet The Nations Elie Mystal noticed something unusual about the publication date of Alitos forthcoming doorstopper So Ordered: An Originalists View of the Constitution, the Court, and the Country. Its scheduled to hit bookstores on Oct. 6, the second day of the Courts 2026-27 term. Alito, whose appreciation for private jet travel is well-established, would ordinarily be due at his day job.

(8,212 posts)If we do, Dems should pull a Mitch McConnell. None of that gentlemanly follow the norms crap. McConnell stole 2 seats. If we flip the senate, we should follow his lead.

(1,296 posts)And I doubt any other openings come up the next couple of years. Thomas seems intent on breaking the record for longest serving justice which is another few years away. I suppose Roberts could step down, but i don't see it. The other conservative justices are too young and will likely be there another 15-20 years (at least).

(2,576 posts)If it happens the seat isnt filled by next year (which I find unlikely) they should pull a mcconnell and block it till a democrat is president.
Another (unlikely) possibility could be adding seats early and getting trump to appoint liberals with a bit of dealmaking.
I think the best course will be adding seats to the court under the next true dem trifecta. But adding seats with a healthy dem majority and a republican president could see some positive consequences since Trump would likely still want to appoint somebody but will be confined by the approval of the Democratic led Senate? Not gonna lie though: i can see that going wrong in more ways than it probably should.

(22,588 posts)As long as we elect a Democratic trifecta in 2028 that is committed to killing the filibuster and expanding the court to neutralize the current MAGA majority, starting with the this years Dem senate candidates.
That is my litmus test for donations to Dem senate candidates.
Without killing the filibuster and expanding the court, there can be no restoration of rights or repair of the damage from the Trump era.
