Secretary of State Marco Rubio: 'Of course' all people in the U.S. are entitled to due process

Secretary of State Marco Rubio on Sunday defended the Trump administration’s agenda of deporting undocumented immigrants but said that “of course” all people in the U.S. are entitled to due process. “Yes, of course,” Rubio told NBC News’ “Meet the Press” when asked whether citizens and noncitizens in the U.S. are entitled to due process. His comments come as the Trump administration has pressed the courts to allow the immediate deportations of immigrants it accuses of being members of the Tren de Aragua gang under the Alien Enemies Act without giving them a chance to plead their case before a judge.

Last week, the Supreme Court asked the administration to pause deportations of some Venezuelan men based in Texas who the Trump administration said were members of Tren de Aragua, with attorneys for the immigrants asking for them not to be deported “before the American judicial system can afford them due process.”

That decision came after the Supreme Court in early April allowed the Trump administration to move forward with some deportations under the AEA as long as detainees “receive notice after the date of this order that they are subject to removal under the Act.” “The notice must be afforded within a reasonable time and in such a manner as will allow them to actually seek habeas relief in the proper venue before such removal occurs,” the Supreme Court justices added.

On Sunday, the secretary of state defended the Trump administration’s deportation efforts, which have included deporting three children who are U.S. citizens — ages 2, 4 and 7 — alongside their mothers, according to The Washington Post. “Their mothers, who were illegally in this country, were deported. The children went with their mothers,” Rubio told moderator Kristen Welker. “If those children are U.S. citizens, they can come back into the United States if there’s their father or someone here who wants to assume them. But ultimately, who was deported was their mother, their mothers who were here illegally. The children just went with their mothers,” the secretary of state added.

Deporting or separating families is not the issue. How monstrous is it that you think that it is the choice? You are parroting Rubio's main talking point, his big lie. This illustrates the problem with the weak compromised so-called liberal media. The way they report stories leads to people being confused about the issues.

It is illegal to deny anyone due process, regardless of their paperwork. It is illegal to deport US citizens, regardless of their age.

This is not about "deporting." It is kidnapping and trafficking.

That is what I am objecting to about your post. Deporting people without separating their families is better than separating them is what Rubio said.

You say "STOP FUCKING DEPORTING PEOPLE IN THE FIRST PLACE." That doesn't address the warrantless arrests and the denial of due process. The question was about due process. We have seen family separations, illegal arrests, denial of due process, people held incommunicado without legal counsel, rape, beatings denial of healthcare, and indefinite detention for years in the war that has been waged against the farm workers here.

I'm against deportations in general. Especially the way they are doing it now. But from what I understand these particular deportatiions are controversial simply because US citizens were deported with their parents who had due process before being deported.

Were they not given an immigration hearing, did a judge not give them a deportation order with enough time to respond? Was there a protective order like for Abrego Garcia? Were they rounded up without notice like the Venezuelans they kidnapped to el salvador? From what I can tell, that doesn't pertain to this case. But while i wont be happy to be wrong, I will accept it as another horrible deviation from the rule of law on top of all the others that we are seeing...

These cases are horrifyingly inhumane and will likely cost a lot of people their lives, but that doesn't mean it was necessarily unconstitutional.

The child, whose redacted U.S. birth certificate was filed in court and showed she was born in New Orleans in 2023, had been with her mother and sister during a regular immigration check-in at the New Orleans office of Immigration and Customs Enforcement on Tuesday. Officials there detained them and queued them up for deportation.

Even so this is very obviously not the same as kidnapping people to el salvador. And the process -while questionable, is not unlikely to pass muster when reviewed by another court. They are treading on very questionable territory, for sure, but this is definitely not a hill I'm going to die on.

Revoking visas without notice -even retroactively, deporting people because of speech, and holding people without ANY trial or due process like so many others, is what we should be focused on.

Just to be clear. I believe deportations in and of themselvss are inhumane and should be illegal. But that doesn't mean the government doesn't have the right to do it, or that every questionable deportation is illegal and unconstitutional. I believe deporting anybody is wrong and comes at a much higher cost than keeping them here. Hypocrites tend to believe there are just deprotations and unjust deportations. That's just bullshit. All deportations are unjust.
