U.S. citizen seeks $1 million after arrest, detention for recording immigration raid

The Mexican American Legal Defense and Educational Fund (MALDEF) said Wednesday they were preparing to initiate a $1 million lawsuit on behalf of a U.S. citizen detained in Los Angeles after recording a raid at a local Home Depot store.
The civil rights organization filed a claim against Immigration and Customs Enforcement (ICE), U.S. Customs and Border Patrol and the Department of Homeland Security (DHS) regarding the treatment of Job Garcia, 37, a Ph.D. student and photographer.
MALDEF said immigration officers threw Garcia on the ground, then knelt on his back and neck as they handcuffed him for recording the raid and advising a commercial truck driver being questioned not to exit his vehicle or answer questions from law enforcement. He was held in custody for more than 24 hours, according to the organization.
Border Patrol and ICE punished me for informing others of their rights and for exercising my own rights, Garcia said in a Wednesday release. He said that at no time did the agents warn him to move away or to stop recording before his arrest.

(11,887 posts)Their Nazi laws. Don't need the Dancing Supremes to take care of every single Nazi suppression tactic. They just hide in DC and support constitutional violations, setting precedent for more constitutional abuses.
It's amazing how money has bought up our legal system. Can we even call it a legal system anymore?
NJCher
(40,839 posts)You know it.
All judges do not dance to the same tune.
This is how we go down, though. By letting them mentally defeat us so there is no impetus to try.

(11,887 posts)You can criticize the overwhelming Nazi bent to precedent being set by the Dancing Supremes AND you can fight. The 2 are not mutually exclusive.
Yes, there are some normal judges remaining but they would be overturned on appeal if they violate the standards being set by the top court.

(11,887 posts)You propose not criticizing and Not pointing out the obvious Nazi bent of the legal system.
OK, if that's the only way you can keep fighting. I'd rather have you on our side. But not everyone needs that kind of perspective to fight the good fight.

(40,839 posts)Here's what you said:
You can criticize the overwhelming Nazi bent to precedent being set by the Dancing Supremes AND you can fight. The 2 are not mutually exclusive.
++To actually make that assertion, what you'd have to do is first define "Nazi." Second, after you have that definition, you'd have to go through all the court decisions and classify them according to your definition of Nazi. If you come up with a majority, that's still not good enough. It has to be an overwhelming majority to characterize an entire set of judgments from one court as bending to a particular definition.
Hey, go ahead. Have at it. If you're not up for the challenge, I suggest you temper your broad, sweeping statements because there are a lot of people here who just might buy into it.
All I'm telling you is the what I used to have to tell writers of theses and dissertations whether their characterizations of a situation were going to fly in the face of a board of critics.

As to your other statement: AND you can fight.
++Sure you can as a demoralized "soldier." Just ask Putin how he does it.

(11,887 posts)Nazis who don't follow any laws.
If you don't know what Nazi is, my definition is never going to convince you. You do not need to start with definitions of obvious and well known descriptors.
No, I don't need to add up every state's minor ruling and decision to know that the top court has turned our legal system into a Nazi fun house. It started with forced birth....which the Nazis love, and continues with the decision to hold persons and deprive them of liberty without due process of law. I word it this way as I am quoting directly from the fifth amendment to the US Constitution. Something that use to matter in the US.
And ignoring rights under a stipulated constitution is just fine and dandy by most any Nazi. Especially those Nazis on the Supreme Court and those following the lead of the highest court through out the states.
I will continue to post my thoughts and fight against Nazis even if they pretend to be something else.

(40,839 posts)And trying to characterize it as fact.
Im telling you the accepted standards for a fact-based definition. I have undergone the education and certification to be one of the people who teaches how to do this in American colleges and universities.
Your response shows you dont understand the requirements for making such a statement.
Until you do, any person who has been educated to think critically will determine your labeling as subjective. It doesnt meet the standard to be taken seriously.

(21,377 posts)offering a jaundiced view of the (formerly) s.c. edicts will keep letting them know that we don't like the way they are shaping the country into something unrecognizable. Maybe one of these days, one of our pokes will make it to their brains and we'll get an attitude adjustment.
I dis every rwnj whenever I can, just to be sure there's a voice in the wilderness. I try not to let discouragement overwhelm me.

(11,887 posts)With a conscious in check. "You can't fight back because that prevents me from exercising my right to abuse you." "Keep the peace" "Be better than they are." These are all sayings the psycho Nazis love to use.
Sometimes fighting for your rights requires hitting back.
