Missouri Supreme Court upholds ban on gender-affirming care for minors

Missouri's high court heard arguments on Sept. 24, 2025, and handed down the unanimous decision Tuesday.

The law, passed in 2023, prohibits health care providers from performing gender-transition surgeries on minors or prescribing cross-sex hormones or puberty-blocking drugs to minors. Under the law, a health care provider's license could be revoked if they prescribe gender-affirming drugs.

The law, enacted through Senate Bill 49, also bans the use of Medicaid funds for gender-affirming care, for both children and adults. The law also prohibits incarcerated people from receiving gender-affirming care.

Three children and adults acting on their behalf, medical providers, a medical health professionals organization and an advocacy organization filed a lawsuit against the state in July 2023, claiming SB 49 violated the Missouri Constitution.
