West Hills race invalidated for a second time one week before Election Day
The election for the proposed West Hills township has been invalidated for a second and seemingly final time, less than one week before Election Day.
The Utah Supreme Court previously paused proceedings in a property rights lawsuit opposing the incorporation process at the request of town sponsor Derek Anderson, but reversed its stance on Tuesday afternoon after a last-minute hearing.
The original order overruled Summit County Third District Judge Matthew Bates decision to invalidate the election, meaning the Summit County Clerks Office would count votes cast for or against the township after all. However, the states highest court ultimately sided with Bates and nullified the ballot measure. Tuesdays order did not give many details regarding the courts reasoning, but it mentioned the potential disruption to the election process as a key factor in the decision.
We are pleased the Utah Supreme Court acted so quickly, and (we) believe the decision is fair and that justice prevailed, said Janet Conway, an attorney representing the 10 plaintiffs who filed the initial lawsuit.
