At last. SCOTUS remembers that Congress is a separate and co-equal branch of government, to whom the Constitution assigns the power to levy taxes. One of Trump’s favorite levers is removed from the arsenal of extortion.

BREAKING: The Supreme Court has struck down President Trump's tariff authority, saying his claim of emergency authority to issue sweeping tariffs to America's trading partners was unlawful.



Roberts, writing for the majority, says Trump's claim of an emergency to issue unbounded tariffs on whoever he feels like flies in the face of decades of law and practice.



Chief Justice Roberts: "The president asserts the extraordinary power to unilaterally impose tariffs of unlimited amount, duration, and scope. In light of the breadth, history, and constitutional context of that asserted authority, he must identify clear congressional authorization to exercise it."

The tariffs case doesn’t say presidents can’t impose tariffs. It rejects Trump’s ability to do it under a law that doesn’t even mention tariffs. He tried to use it to claim much broader, completely unrestricted powers than the ones Congress has given the president.




...Trump should be required to give the stolen money back to consumers. Here come the lawsuits by businesses and sellers who paid the tariffs, as well.
