Judge Chutkan to decide whether to impose gag order on Trump to protect witnesses/promote fair trial [View all]

Donald Trump is on Pretrial release in four felony cases, including a federal case in Washington, DC, for his attempt to overturn the results of the 2020 presidential election.

On Monday, October 16, District of Columbia federal court judge Tanya Chutkan will hold a hearing on Special Counsel Jack Smith's motion seeking restrictions on defendant Donald Trump's speech and posts to protect the witnesses, to prevent Trump from poisoning the jury pool, and to preserve the people's right to a fair trial.

This video discusses the Supreme Court precedent that allows a trial court judge to impose restrictions on a defendant's speech - without running afoul of the First Amendment - to prevent a defendant from saying things that would "pose a substantial likelihood of prejudicing" court proceedings. - Glenn Kirschner - 10/15/2023.
