this is before the 2nd Senate trial: that didn't start until the beginning of February 2021. McConnell goes ahead with his statement that Donnie should be tried in the courts: the new AG jumps on this. And keeps on it: even if Roberts decides to punt, the government presents evidence that Trump was involved in planning the insurgency and that doesn't go away - the DoJ doesn't let it get brushed over while going for the low-hanging fruit. In my scenario, the AG is more aggressive about prosecuting Donnie for taking classified documents home with him, and more aggressive about finding and trying the people who were filmed assaulting police.

(non sequitur: I read recently that experienced fruit pickers go for the higher hanging fruit first, since it's easier to pick the ones higher up in the trees while the basket is still light and nearly empty, then pick up the rest as they go down)
